The Dangers of Using Artificial Intelligence (AI) for Legal Advice
Artificial Intelligence (AI) is transforming how we live and work. In terms of helping us to work faster and reduce administrative burdens, it can be an incredible tool. However, there have been several instances of AI providing unreliable or inaccurate information when it is used for legal research or legal advice. As such, we recommend employing considerable caution when utilizing ChatGPT or other AI-powered services.
Even when such services provide answers in a confident manner, there is reason to take this information with a grain of salt. Even attorneys have had problems when they rely on AI. There have been numerous media reports of incidents in California, Wyoming, Utah, and even London where lawyers were sanctioned for relying on legal research generated by AI that was later found to be inaccurate or entirely fabricated.
We recently had a person come to us following the denial of their United States Green Card application. Upon learning the circumstances of the application, we came to understand that AI had provided the client with advice that led them to apply for an immigrant visa for which they were not eligible. Specifically, they applied under the Child Status Protection Act, which is a law used to determine whether children over the age of 21 can still be considered children for immigration purposes. While AI advised the applicant that they were eligible to apply under the law, this advice was incorrect. As such, the embassy correctly rejected the application.
AI-powered services such as ChatGPT can be incredibly helpful as a tool for modern life. However, we wish to caution our clients and other attorneys that this technology has, to date, proved unreliable concerning the issuance of legal advice.
