1. In Colombia it’s called a "sucesión"
In many countries, inheritance matters can have different names: succession, probate, estate, testate and intestate matters. In Colombia, it’s called a sucesión.
2. Was there a will?
One of the first steps is determining whether the deceased left behind a valid will or testament. If no will exists, the estate will be distributed according to Colombian laws, which prioritize certain family members.
3. You can process an inheritance through a notary or a court
Inheritance proceedings in Colombia can take place either through a Notary or the Court system, depending on the situation.
Notarial Succession: This is a faster and more straightforward process, however, it is only available when all heirs and creditors agree on the distribution, and there are no legal disputes.
Court Probate: If there are disagreements among heirs, creditors, or complex legal issues, the case must go through the court system.
4. Documents can expire in Colombia
Unlike in many other countries, copies of official documents in Colombia—such as birth, marriage, or divorce certificates—may expire after 90 days. Work with your attorney to determine which documents will require fresh copies.
5. Don’t overlook the debts
While many people focus on what they’ll receive from an inheritance, it's important to remember that any debts or tax liabilities attached to the estate will also have to be settled.
6. Language and distance can create barriers
